This Privacy Policy explains how AE Labs Inc. ("we", "us" or "our") collects, uses, and protects your Personal Data when you use Æ. Terms used in this Privacy Policy are used with the same meaning as in our Terms of Service.

You consent to be legally bound by this Privacy Policy as published and from time to time updated. Do not use our Services if you do not agree with our Terms of Service and Privacy Policy.

Personal Data

"Personal Data" ("Data") means information that identifies or is reasonably capable of identifying an individual, directly or indirectly, and information that is capable of being associated with an identified or reasonably identifiable individual.

Data We Collect

We are not here to track you. We do not use cookies. We collect only the minimum Data strictly necessary to operate, maintain, and improve Æ — nothing more.

Data You Provide Directly:

  • email address when registering or logging in;
  • your hedera wallet address;
  • Content you create, post, or share, including posts, chat messages, and Amplified Content;
  • Feedback or support requests you submit.

Data Collected in Accordance with the Terms of Service of OneSignal Operated by OneSignal Inc., the Push Notification Functionality Provider:

  • your mobile advertising identifiers;
  • your email addresses;
  • your IP address;
  • your device push token;
  • your precise location (e.g., GPS-level) data;
  • network information;
  • language;
  • time zone;
  • product preferences;
  • and privacy preferences.

Data We Collect from Third Parties:

transaction information such as public blockchain data. Digital Assets are not truly anonymous. We, and any others who can match your public Digital Asset address to other Data about you, may be able to identify you from a blockchain transaction because, in some circumstances, Data published on a blockchain (such as your Digital Asset address and IP address) can be correlated with Data that we and others may have. Furthermore, by using data analysis techniques on a given blockchain, it may be possible to identify other Data about you.

How We Use Your Personal Data and Legal Bases for Processing

This section describes the purposes for which we process your Personal Data when acting as a data controller and the legal bases for such processing. Where the legal bases specified are not applicable in your country, we will rely on consent or other available grounds to process your Personal Data.

We do not use your Personal Data for targeted advertising. We do not sell your Personal Data.

  • We rely on contractual necessity (the processing is necessary for entering into, or performance of a contract to which you are a party), when we use your Personal Data to provide you with our Services pursuant to our Terms of Services; to create, maintain, and authenticate your account and process transactions; to enable social and messaging features; to provide gameplay, AI, and Content tools; to manage Amplified Content; and to fulfill your purchases.
  • We rely on legitimate interest in using your Personal Data when we use it to respond to your inquiries.
  • We rely on legal obligations when we use your Personal Data to comply with legal obligations and respond to lawful requests.

Data Sharing

We share your Data only when necessary:

  • with third party service providers, including XMPT, Railway, Pinata, Privy, OneSignal, xAI, and ElevenLabs to operate the platform;
  • professional advisors, such as lawyers and accountants, where doing so is necessary to facilitate the services they render to us;
  • business transaction recipients, such as counterparties and others assisting with a merger, acquisition, financing, reorganization, bankruptcy, receivership, dissolution, asset sale, or similar transaction, and with successors or affiliates as part of or following that transaction;
  • authorities or international financial organizations, where required to do so for the compliance and protection purposes described above or required by applicable law or valid legal process;
  • our current and future affiliates, meaning an entity that controls, is controlled by or is under common control with us. Our affiliates may use the Personal Data we share in a manner consistent with this Privacy Policy;
  • with individuals who claim that any material that you submit to Æ infringes their intellectual property and other proprietary rights.

Data Transfers and Third Party Service Providers

Although this section applies to all users, if you are located in the European Economic Area ("EEA"), United Kingdom ("UK") or Switzerland, please read this part carefully.

Since we use multiple third party service providers to operate our Services, your Personal Data may be transferred by these providers outside your country, state, or province of residence, including outside the EEA, the UK, and Switzerland. We do not control the privacy practices of any third party providers we use, and they are not covered by this Privacy Policy. The list of currently used third party service providers and what we use their services for is below. You should review their terms and privacy policies to learn about their data protection practices.

Accuracy and Data Retention

We take reasonable and practicable steps to ensure that your Personal Data held by us is (i) accurate with regard to the purposes for which it is to be used and (ii) not kept longer than is necessary for the fulfilment of the purpose for which it is to be used.

Data Security

We use appropriate technical and organizational measures to protect your data, including:

  • minimal data collection and no cookie tracking;
  • end-to-end encrypted messaging operated by XMTP;
  • non-custodial wallets provided by Privy
  • smart contract logic for Amplified Content refunds in case of non-approval.

Despite our efforts, no system is 100% secure.

Your Rights

You can freely exercise the following rights:

  • To obtain confirmation as to whether or not your Personal Data are being processed.
  • To request access to and/or a copy of the Personal Data we process about you.
  • To request us to amend or rectify your Personal Data (we may need to verify the accuracy of the new data you provide to us).
  • To erase Personal Data, or "right to be forgotten" if one of the following applies: (i) the Personal Data are no longer necessary in relation to the purposes for which was collected or otherwise processed; (ii) you object to the processing, and there are no overriding legitimate grounds for the processing; (iii) the Personal Data have been unlawfully processed.
  • To object to us processing your Personal Data where we are relying on legitimate interests as the lawful basis and you feel the processing impacts on your fundamental rights and freedoms. In some cases, we may refuse your objection if we can demonstrate that we have compelling legitimate grounds to continue processing your Data which override your rights and freedoms.
  • To restrict Personal Data processing if one of the following applies: (i) the accuracy of the Personal Data is contested; (ii) the processing is unlawful, and you object to the erasure of the Personal Data and request to restrict its use instead; (iii) we no longer need the Personal Data for the purposes of the processing, but they are required by you to establish, exercise or defend legal claims
  • To be informed as to rectification or erasure of Personal Data or about imposition of the restriction on its processing.
  • To withdraw your consent at any time where we are relying on consent to process your Personal Data. This does not affect the lawfulness of any processing carried out before you withdraw your consent, and after withdrawal, we may not be able to provide certain Services to you. We will advise you if this is the case at the time you withdraw your consent.

Children's Privacy

Our Services are not intended for individuals under the age of 18, and we do not knowingly collect Personal Data from children. If we learn we collected Personal Data from a person under 18, we will delete that information from our files.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If the changes, in our sole discretion, are material, you will be notified by email or in-app notification 30 days before they come into force.
